Heather Dlhopolsky is a partner in the firm’s Land Use/Zoning Practice. She works on all matters of land use and zoning issues for projects including mixed-use, multi-family, and commercial properties. Her clients have included commercial and multi-family developers, institutions, and churches, among others.

Heather’s work demonstrates meticulous attention to detail and a drive to navigate through complex obstacles. She applies these attributes to provide skilled representation on land use, planning, and zoning processes such as CR Zone optional method development projects, master plans and sector plans, and conditional use (special exception) applications. She has extensive familiarity with complex zoning and subdivision regulations, as well as related laws, such as those concerning moderately priced dwelling units (MPDUs).

Her practice covers Montgomery, Prince George’s, and Charles counties and their municipalities, where she interacts extensively with local government entities, including the Montgomery County and Prince George’s County Planning Boards and County Councils, Charles County Planning Commission and County Commissioners, Montgomery County Board of Appeals and Hearing Examiner, Montgomery County and Prince George’s County circuit courts, Montgomery District Court, Rockville Planning Commission, and various city councils and mayors’ offices. She also has in-depth knowledge of and experience with the planning departments and permitting agencies in these jurisdictions.

Heather acts as a true partner to clients, taking on their goals as her own and placing a high priority on responsive service. Her strong interpersonal skills and optimistic outlook facilitate productive and positive interactions with all stakeholders in a project.

Heather cares deeply about the regions she serves and has earned a reputation for giving back to her community, while developing relationships that enhance her practice. She is active in leadership positions with the Greater Bethesda Chamber of Commerce and (formerly) Western Montgomery County Citizens Advisory Board, and chaired the Montgomery County Nighttime Economy Task Force, having been appointed by the county executive to develop recommendations to improve the nighttime business climate. In addition, she has taught real estate at the University of Maryland, and served as chair of the Events Committee and currently serves as chair of the Marketing Committee at Linowes and Blocher. She is also actively involved in pro bono legal work in the Montgomery County community.

  • Provided land use and zoning representation for Cheval Bethesda, a mixed-use redevelopment currently under construction in Bethesda
  • Assisted with the land use and zoning representation for Solaire Silver Spring, a high-rise apartment building in the Ripley District of the Silver Spring Central Business District
  • Assisted with the land use and zoning representation for Ripley East, a future mixed-use redevelopment in the Ripley District of the Silver Spring Central Business District
  • Assisted with the land use and zoning representation for Saul Centers White Flint, a future mixed-use redevelopment near the White Flint Metro Station in the Pike District
  • Assisted with land use and zoning representation for Studio Plaza, a future mixed-use redevelopment in the Fenton Village area of the Silver Spring Central Business District, and handled land use and zoning matters related to a highly complex closing between the county and private parties
  • Assisted with obtaining all land use and zoning approvals for Solaire Bethesda, a mixed-use redevelopment currently under construction in Bethesda, and handled numerous amendments of the approvals
  • Assisted with land use and zoning matters for the Flats at Bethesda Avenue and The Darcy, a mixed-use redevelopment in Bethesda, and handled the affordable housing (MPDU and workforce housing) requirements at the project
  • Assisted with obtaining project plan, preliminary plan of subdivision, and site plan amendments for 8300 Wisconsin Avenue, Flats 8300, a mixed-use redevelopment wrapping up construction in Bethesda, and obtained all sign permits for the project
  • Assisted with obtaining preliminary plan of subdivision and site plan approvals for Holy Cross Hospital, Germantown
  • Assisted with the special exception approval for Holy Cross Hospital, Silver Spring, and obtained numerous amendments, as well as sign permits, for the project
  • Assisted with land use and zoning representation for Bainbridge Bethesda, a mixed-use high-rise in the Woodmont Triangle area of Bethesda
  • Assisted with the land use and zoning representation for Summerfield at Morgan Station, a future townhouse development across from the Morgan Boulevard Metro Station in Landover
  • Assisted with the land use and zoning representation for Town Center at Camp Springs, a future mixed-use redevelopment near the Branch Avenue Metro Station
