Schaller testifies before the Environment and Transportation Committee
On February 25, 2015, Charles Schaller testified before the Environment and Transportation Committee in the Maryland House on HB 509 at the request of Delegate McMillan. HB 509 is a Bill that, should it pass, will impose a 5-year statute of limitations on the Maryland Department of the Environment in seeking administrative penalties for environmental violations from the time the agency knew or should have known of the alleged violation. Currently MDE takes the position there is no limitations period for the agency to seek administrative penalties. HB 509 would be consistent with the federal law that imposes a 5-year limitations period.
